ENVIRONMENTAL LAWS IN INDIA

India’s environmental regulatory framework consists of central environmental Acts, Rules, Notifications, Standards and Guidelines issued primarily under the Environment (Protection) Act, 1986. These regulations govern pollution control, waste management, environmental monitoring, sustainability, environmental clearance and industrial compliance.
This section is intended to create awareness and provide simplified understanding of key environmental laws, their applicability and compliance relevance for industries, laboratories, institutions, environmental professionals and stakeholders.

CORE ENVIRONMENTAL ACTS IN INDIA

       Environment (Protection) Act, 1986| Amended up to 2025
Umbrella environmental legislation empowering the Central Government to issue environmental standards, notifications, directions and waste management rules. Applicable to all industries, infrastructure projects, laboratories, regulators, institutions and environmental monitoring bodies.

Water (Prevention and Control of Pollution) Act, 1974| Amended 2024

Provides framework for prevention and control of water pollution through Consent to Establish (CTE) and Consent to Operate (CTO) mechanisms. Applicable to industries discharging effluent, STPs, CETPs, commercial establishments and local authorities.


           Air (Prevention and Control of Pollution) Act, 1981 | Amended through latest CPCB/SPCB directions
Regulates air emissions and air pollution control measures including industrial emissions, DG sets and fuel combustion systems. Applicable to industries, thermal plants, manufacturing units and emission-generating activities.


           Environment (Protection) Rules, 1986 | Continuously Updated
Prescribe emission and discharge standards, environmental monitoring requirements and sector-specific compliance parameters. Applicable to all environmentally regulated industries and projects.


           National Green Tribunal Act, 2010 | In force
Establishes the National Green Tribunal (NGT) for effective and expeditious disposal of environmental cases and disputes. Applicable to industries, project proponents, government authorities and affected people.

Public Liability Insurance Act, 1991 | In force
Mandates insurance and immediate relief mechanism for accidents involving hazardous substances. Applicable to hazardous chemical industries and units handling notified hazardous materials.


          Forest (Conservation) Act, 1980 | Amended through Forest Conservation Rules & Van (Sanrakshan Evam Samvardhan) Adhiniyam updates
Regulates diversion of forest land for non-forest purposes and governs forest clearance mechanisms. Applicable to mining, infrastructure, transmission, industrial and development projects involving forest land.


         Wildlife (Protection) Act, 1972 | Amended up to 2022
Provides protection to wildlife species, habitats and protected areas including national parks and sanctuaries. Applicable to industries, tourism, infrastructure and projects near eco-sensitive areas.


         Biological Diversity Act, 2002 | Biological Diversity (Amendment) Act, 2023
Regulates access to biological resources and associated traditional knowledge while promoting conservation and sustainable use. Applicable to research institutions, biological resource users, industries and foreign entities.


          EIA Notification, 2006 | Amended up to 2025
Provides Environmental Clearance (EC) framework for industrial, mining, construction and infrastructure projects based on environmental impact assessment. Applicable to notified projects under the Schedule of the Notification.


WASTE MANAGEMENT RULES

 Solid Waste Management Rules, 2026 | Effective from 1 April 2026
Govern scientific segregation, collection, processing, treatment, landfill management and remediation of municipal solid waste and bulk waste. Applicable to urban local bodies, bulk waste generators, institutions, industries and waste processing facilities.


          Plastic Waste Management Rules, 2016 | Amended up to 2026
Establish Extended Producer Responsibility (EPR), recycled content obligations and plastic waste management requirements. Applicable to Producers, Importers and Brand Owners (PIBOs), plastic manufacturers, recyclers and processors.


          E-Waste (Management) Rules, 2022 | Effective from 1 April 2023
Provide EPR-based framework for collection, recycling and environmentally sound management of electronic waste. Applicable to producers, manufacturers, refurbishers and recyclers of electrical and electronic equipment.


          Battery Waste Management Rules, 2022 | In force
Introduce mandatory collection and recycling obligations under EPR mechanism for batteries. Applicable to battery producers, importers, assemblers, refurbishers and recyclers.


          Bio-Medical Waste Management Rules, 2016 | Amended up to 2024
Regulate segregation, storage, transportation, treatment and disposal of biomedical waste generated from healthcare activities. Applicable to hospitals, laboratories, clinics, blood banks and healthcare facilities.


           Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 | Amended up to 2022
Regulate generation, storage, treatment, recycling, utilisation, import and export of hazardous waste. Applicable to chemical, pharmaceutical, metal processing, manufacturing and hazardous waste generating industries.


          Construction and Demolition Waste Management Rules, 2016 | In force
Provide framework for handling, storage, transportation and recycling of construction and demolition waste. Applicable to infrastructure projects, builders, contractors and demolition agencies.


          Used Oil Management Rules, 2024 | Recently Notified
Provide EPR-based framework for environmentally sound collection, recycling and utilisation of used oil. Applicable to producers, importers, recyclers and industries generating used oil.

CHEMICAL & INDUSTRIAL SAFETY REGULATIONS

Manufacture, Storage and Import of Hazardous Chemical Rules, 1989 | Amended
Prescribe safety measures for handling, storage and import of hazardous chemicals including accident prevention and emergency planning. Applicable to chemical industries and Major Accident Hazard (MAH) units.

          Chemical Accidents (Emergency Planning, Preparedness and Response) Rules, 1996 | In force
Provide institutional framework for emergency preparedness and response during chemical accidents. Applicable to hazardous chemical handling industries and district/state authorities.

Ozone Depleting Substances (Regulation and Control) Rules, 2000 | Amended
Regulate production, sale, use and phase-out of ozone depleting substances under international environmental commitments. Applicable to refrigeration, air-conditioning and chemical sectors.


NOISE, MONITORING & ENVIRONMENTAL STANDARDS

Noise Pollution (Regulation and Control) Rules, 2000 | Amended
Prescribe ambient noise standards and restrictions for industrial, commercial, residential and silence zones. Applicable to industries, DG sets, event organisers, urban local bodies and infrastructure projects.

          Environment Protection (Manner of Holding Inquiry and Imposition of Penalty) Rules, 2024 | Newly Introduced Compliance Framework
Provide adjudication and environmental penalty mechanism for environmental violations under amended EPA provisions. Applicable to regulated entities and environmental non-compliance proceedings.

         Continuous Emission / Effluent Monitoring Guidelines (CEMS / CEQMS) | CPCB Directions Updated Periodically
Mandate online continuous environmental monitoring systems for specified industries. Applicable to highly polluting industries, CETPs, STPs and major industrial sectors.
